The Claim That Bankrupted a Business — Even Though They Had Insurance

Most business owners believe that if they have insurance, they’re protected.

But after nearly three decades in commercial insurance, I’ve learned something most people never discover until it’s too late:

Insurance rarely fails because of bad luck.
It fails because of structure.

A few years ago, I worked with a business owner who had what looked like a solid insurance program.

They had:

• General Liability
• Property Coverage
• Workers' Compensation
• An Umbrella Policy

On paper, everything looked fine.

Then a serious incident happened.

A customer was injured on their property and a lawsuit followed. What started as a routine claim quickly turned into a six-figure legal problem.

The owner wasn’t worried.

They believed their umbrella policy would step in once the general liability limits were reached.

That’s exactly what umbrella coverage is supposed to do.

But when the claim was reviewed, something unexpected happened.

The umbrella carrier refused to respond.

Why?

Because during a renewal the previous year, a small change had been made to the underlying liability policy.

No one noticed it.

The agent didn’t highlight it.
The owner assumed the renewal was routine.
The paperwork looked like every other renewal packet.

But buried inside that change was a structural break in the coverage.

That small change meant the umbrella policy no longer sat properly on top of the underlying policy.

In insurance terms, the coverage stack was broken.

Which meant the umbrella carrier had no obligation to drop down.

And suddenly the business owner found themselves personally responsible for a claim they believed was insured.

That single structural mistake cost them hundreds of thousands of dollars.

The uncomfortable truth

Most business owners don’t lose money because they don’t have insurance.

They lose money because their insurance is built incorrectly.

After 28 years in this business, I see the same patterns over and over:

• Coverage stacked in the wrong order
• Deductibles misaligned with cash flow
• Endorsements added without strategy
• Policies renewed without negotiation

None of these mistakes look dangerous during renewal season.

But when a claim hits, they become very expensive problems.
